RESPONSE TO THE DIFFUSED COMMUNICATION BY THE SECRETARIAT AUX HYDROCARBURES

LE SECR\u00c9TARIAT AUX HYDROCARBURES PLANIFIE LE DEMEMBREMENT DU TERRITOIRE KICHWA DE LA SOURCE DU FLEUVE BOBONAZA<\/strong><\/p>\n

Dans son communiqu\u00e9 titled \u201cThe \u00e9tat \u00e9quatorien recueille des informations dans la zone des blocs 74 et 75 dans le respect of the Constitution et la Loi<\/em>\u201c, it is mentioned in a \u201cPr\u00e9alable Consultation\u201d which has been carried out during the months of March and April. L'article 57, Chapter 7 of the Constitution \u00e9quatorienne conf\u00e9rant aux peuples autochtones le droit \u00e0: \u201cUne consultation pr\u00e9alable, libre et publique, men\u00e9e dans un d\u00e9lai raisonnable<\/strong>, on all the plans and programs of prospection, d'exploitation and commercialization of non-renewable resources situated on the land and susceptible to affecting the environment and culture\u201d (\u2026).<\/p>\n

Il y esta \u00e9galement I affirmed that the consultation process was carried out in accordance with the applicable regulations in the matter: \u201cThe consultation process will be carried out with all the communaut\u00e9s directly touched\u00e9es<\/em>\u201c, ce qui ne fut pas respect\u00e9 puisque the \u201cconsultation\u201d in the lieu dans aucune des 7 communaut\u00e9s qui composent le Peuple Kichwa de Sarayaku<\/strong> (Sarayaku Centre, Kalikali, Shiwakucha, Kushilu Urku, Pista et Mawka Llakta 7 Chuntayaku).<\/p>\n

Cette \u201cconsultation\u201d is in another ill\u00e9gale puisqu'elle n'a pas tenu compte du D\u00e9cret 1247 which provides for the participation of indige- nous peoples according to the verdict of the IACHR:<\/p>\n

According to the terms of paragraph 301 of the verdict: \u201c<\/em>L'Etat doit adopt the legislative measures<\/strong>, administratives et d'autre nature que sont n\u00e9cessaires pour mettre pleinement en marche et rendre effectif le droit \u00e0 la consultation pr\u00e9alable<\/strong> des peuples et des communaut\u00e9s autochtones et tribales, for lequel doit \u00eatre assur\u00e9e the participation of the concerned local communaut\u00e9s<\/strong>;\u201d<\/em><\/p>\n

UNE ETUDE D'INCIDENCE ENVIRONNEMENTALE SANS PARTICIPATION EFFECTIVE DES COMMUNAUT\u00c9S<\/strong><\/p>\n

Nous d\u00e9non\u00e7ons face \u00e0 l'opinion publique nationale et internationale la mise en place d'un d\u00e9membrement du territoire collectif de Sarayaku which is based on the recognition d'une fausse self-determination des fronti\u00e8res de leur territoire par de petites communaut\u00e9s comme cells de Teresa Mama, Chuva Cocha et Molino comme cela fut exprim\u00e9 by M. Alexis Guerrero, fonctionnaire du Secr\u00e9tariat aux hydrocarbures. The strategy used by the previous governments is in the process of being repeated.<\/p>\n
