On July 6 and 7, 2011, in San Jos\u00e9, Costa Rica, the hearing of the Case will be held.\u00a0sarayaku <\/em>before the Inter-American Court of Human Rights.<\/p>\n

This diligence is crucial because in it the Kichwa people of Sarayaku, from the Ecuadorian Amazon, will present their oral arguments before the judges of the Court, as well as the testimonial and expert evidence with which they will demonstrate the human rights violations they suffered during the oil activity. of Block 23.<\/p>\n

From Sarayaku a delegation of leaders, traditional wise men and women of the community will travel to Costa Rica. They will be accompanied by their lawyers, Mario Melo from Fundaci\u00f3n Pachamama, Viviana Kristicevic and Ariela Peralta from the regional human rights organization CEJIL.<\/p>\n

In 2003 Sarayaku went before the Inter-American Commission, based in Washington DC, to denounce the violation of his human rights committed by the Ecuadorian State when it granted his ancestral territory in 1996 for oil activities without having consulted him and asked for his consent. It was also denounced that between the end of 2002 and the beginning of 2003, oil workers from the Argentine company CGC and personnel from the Ecuadorian Armed Forces entered the territory titled in favor of Sarayaku, by force and against the will of the owners, to carry out seismic exploration. . As a result of this violent incursion, high-power explosives were planted in the territory of Sarayaku in an amount close to one and a half tons, according to information provided by the Ministry of Mines and Petroleum in 2005.<\/p>\n

At the beginning of this year, the Inter-American Commission presented the Sarayaku case before the Inter-American Court, which will issue a mandatory sentence for the Ecuadorian State, approximately six months after the hearing.<\/p>\n

The sentence is awaited with expectation by indigenous peoples throughout the continent, since it is estimated that it will establish new legal precedents regarding the obligation of States to comply with the right to consultation and consent of indigenous peoples when planning to carry out activities that cause serious impacts on their lives, territories and cultures.<\/p>\n
