RECORD OF MEETING

At 11:00 am on Wednesday, July 2, 2014, the meeting began with the participation of the delegation of the Ecuadorian State and the Government Council of the Original Kichwa People of Sarayaku.

The order of the day is read:

Mr. Félix Santi proceeds to extend his greeting to the delegation of the Ecuadorian State; and, states that this is a meeting to coordinate compliance with the Judgment.

2. Speech by the Vice Minister of Justice, Human Rights and Religions. (E)

The Vice Minister of Justice, Human Rights and Worship (E), Nadia Ruiz M., sends her regards and expresses the will of the State to reach agreements regarding compliance with the Judgment, as well as to communicate the measures implemented by the State Ecuadorian.

The Ecuadorian State has complied with the measures of the judgment ordered by the Inter-American Court. To date, three measures of the sentence are pending coordination.

The Vice Minister of Justice, Human Rights and Worship (E) proceeds to specify the measures that have been executed, which correspond to the publication of the Official Summary of the Judgment, the payment of the amounts ordered by the Court, the establishment of permanent programs of training on the rights of Indigenous Peoples.

Regarding legislative, administrative or other measures, it proceeds to specify the recognition of this right in different normative bodies.

Currently, the pending measures of the sentence are:

The broadcasting of the sentence, for which the translations and locutions were made. Thus, it remains to define the moment of broadcasting and the stations in which they will be transmitted.

Regarding the act of acknowledgment of international responsibility of the Ecuadorian State, it states that the State was willing to comply with this measure; however, the People requested that the President of the Republic be the one to apologize. In this virtue, a national chain of public apologies was carried out without excluding the performance of the act in the terms indicated by the Judgment.

An environmental impact study has been coordinated, which accounts for the effects of removing pentolite from the surface.

Currently, a new leadership has taken office, and it is the intention of the State to reach agreements to execute the measures of the Judgment. Additionally, this meeting will allow us to deepen our mutual knowledge and ratify the commitment of the Ecuadorian State with the People of Sarayaku.

3. Treatment of the Reconnaissance Visit/Environmental Impact Study.

The reconnaissance visit will be confirmed to take place between July 17 and 22, establishing that, depending on weather conditions, the visit would last 5 or 8 days, including the evaluation meeting in Sarayaku.

The number of people who will participate in the reconnaissance visit is 18: 9 delegates from the Sarayaku People and 9 from the Ecuadorian State.

The budget for the reconnaissance visit is examined:

Fuel transfer: 120 gallons of fuel will be transported by river. The Ecuadorian State will recognize the cost of land and river transportation for the transfer to Sarayaku. For this purpose, the State will contact the Sarayaku coordination office in Puyo.

Starting point for the reconnaissance visit: The State and Sarayaku delegates will depart from Sarayaku to the site of the reconnaissance visit. 

Feeding: The delegation of the Ecuadorian State will assume its own food, with regard to obtaining food and transportation to Sarayaku.

4. Act of acknowledgment of international responsibility of the Ecuadorian State:

The Vice Minister of Justice, Human Rights and Worship, Nadia Ruiz, ratifies the authorities that would attend the event, being the same: Minister of Justice, Human Rights and Worship, Minister of the Environment, Minister of Non-Renewable Natural Resources, Minister of Defense, Attorney State General.

In turn, it is stated that in order to coordinate the agenda of the holders of the different State Portfolios, the date of the act is established between September 2 and 5.

A text will be worked on an act of public apology with Dr. Mario Melo.

5. Broadcasting of the Judgment:

It is agreed to broadcast the official summary of the Judgment as follows:

First Sunday in September:  Radio Super Tropicana, in Spanish.

Second Sunday in September:  Radio Tarimiat, in Shuar.

Third Saturday of September: Radio Puyo, in Kichwa.

Fourth Sunday of September: Nina Radio, in Spanish.

6. Various

The issue related to the affectation of Block 79 of the Eleventh Oil Round in relation to the Sarayaku territory is addressed.

At this point, the Vice Minister of Justice, Human Rights and Religious Affairs agrees to organize a meeting with the competent authorities in Quito, with the aim of analyzing this issue.

7. Close of the meeting

Once the agreements established in these minutes have been determined, the meeting concludes at 12:28 p.m. and the present document is signed in three copies of the same tenor.
